Thomas Oxton is a barrister who specialises in Employment Law and Regulatory Law. He represents doctors in employment law disputes, and in fitness to practise proceedings before the General Medical Council (GMC / MPTS).
Employment Law
Thomas Oxton advises doctors in relation employment contract disputes, capability procedures and their fair application, unfair dismissal claims, discrimination claims, constructive dismissal claims, Employment Tribunal (ET) claims and ET procedural applications, employment related compensation claims, redundancy payments advice, representation at employment tribunals, and eamployment Appeal Tribunals (EAT), and general and specialist advice in all areas of employment law concerning medical doctors (registered medical practitioners and student doctors). Thomas Oxton advises employers and employees, including GP Practices, hospitals and clinics, who employ staff that include doctors, nurses, and administrative staff. Thomas Oxton represents both employers and employees in all employment law matters, including the provision of guidance on employer protocols and systems that all employers should have in place, and on employee and partnership contracts and disputes.
Thomas Oxton can also sit on disciplinary, capability, and appeal panels, as an independent person. This is particularly useful for small business entities who need to bring in an independent person to adjudicate on an employment dispute, so as to ensure fairness, or where the organisation has insufficient people to be able to sit in such a role, because of the history of the case.
Regulatory Law (GMC Fitness to Practise)
Thomas Oxton represents doctors before the General Medical Council at interim orders hearings and fitness to practise hearings, concerning misconduct, health and performance issues. Thomas Oxton has specialist expertise in looking after doctors who have alcohol or drug dependencies.
Thomas Oxton advises doctors who ae registered with the GMC, wherever the doctor is resident. He will give advice on preparing for a hearing or how to collate written responses and evidence, to be sent to the GMC. He also advises on expert evidence that will be needed in order to present a doctor’s best case.
